Workers and Unemployment Compensation. Section 19.1. Every Employer who is subject to this Agreement, regardless of the number of persons employed by such employer, shall obtain coverage under the Worker’s and Unemployment Compensation Acts of the State of Wisconsin. Section 19.2. Every Employer agrees that no Employee will be discharged or disciplined in any respect for having filed a claim for compensation for an on-the-job injury. An Employee who loses time because of an injury incurred on the job site or in the course of employment will be reinstated, replacing any Employee hired subse- quent to the injury, provided the injured Employee has not been incapacitated by the injury to such an extent that he is no longer qualified for the work.

Workers and Unemployment Compensation. All workers’ compensation Liabilities relating to, arising out of, or resulting from any claim by a B/E Employee, Former B/E Employee, KLX Employee or Former KLX Employee that results from an accident, incident or event occurring, or from an occupational disease which becomes manifest, prior to the Distribution Date shall be retained by B/E. Effective as of the Distribution Date, KLX, acting through the member of the KLX Group employing each KLX Employee, will be responsible for (a) obtaining workers’ compensation insurance, including providing all collateral required by the insurance carriers and providing all notices to KLX Employees required by applicable workers’ compensation Laws and (b) establishing new or transferred unemployment insurance employer accounts, policies and claims handling contracts with the applicable government agencies.

Effective as of the Closing Date, the Transferee will be responsible for obtaining workers’ compensation insurance, including providing all collateral required by the insurance carriers and providing all notices to Transferred Employees required by applicable workers’ compensation laws and establishing new or transferred unemployment insurance employer accounts, policies and claims handling contracts with the applicable government agencies

No employee will be discharged or disciplined in any respect for filing a claim for compensation relating to an on-the-job injury. Any employee who loses time because of an injury incurred on the job site or in the course of his/her employment will be reinstated to his/her former position replacing any employee hired subsequent to the injury, provided he/she can perform the work.

Workers and Unemployment Compensation. The Selling Parties shall retain Liability for all workers compensation and unemployment claims for Employees arising prior to the Closing Date. The Purchaser shall be responsible for all workers compensation and unemployment claims for Transferred Employees arising after the Closing Date. Purchaser shall be responsible for providing or discharging any and all notifications, benefits, and Liabilities to Transferred Employees and Governmental Authorities required by applicable Law relating to employee separations or severance pay that are first required to be provided or discharged after the Closing Date, including pre-Closing notice or Liabilities if actions by Purchaser after the Closing Date result in a notice requirement or Liability under such Laws. The Selling Parties shall be responsible for providing or discharging any and all notifications, benefits, and Liabilities to Employees and Governmental Authorities required by applicable Law relating to plant closings or employee separations or severance pay that are first required to be provided or discharged on or prior to the Closing Date. All Employees involuntarily separated from employment by a Selling Party within 90 days prior to the Closing Date, the involuntary separation of whom could result in or affect a notice requirement covered by this Section 11.4, shall be identified on a schedule to be prepared by the Selling Parties (Schedule 11.4) and submitted to Purchaser on the date hereof, and shall be updated by the Selling Parties as of the Closing Date. Purchaser and the Selling Parties shall cooperate with each other to provide timely notice, if required, to any Governmental Authority of the consummation of this Agreement and the related transfer of employees.
Workers and Unemployment Compensation. Section 5.01 For all employees covered by this Agreement, the Employer shall carry workers compensation insurance and such other protective insurance as may be required by state laws, and the Employer shall furnish satisfactory proof of such to the Union when requested. The Employer shall also make payments to the applicable state unemployment compensation commission for all employees covered by the terms of this Agreement and shall pay all other taxes as may be required by state and federal statutes.
