Workmanship Warranty Sample Clauses

Workmanship Warranty. Contract warrants that all components or deliverables specified and furnished by or through Contractor under the Project Definition/Work Order meet the completion criteria set forth in the Project Definition/Work Order and any subsequent statement(s) of work, and that services will be provided in a workmanlike manner in accordance with industry standards.
Workmanship Warranty. We warrant our Work for a period of twenty (20) years after installation (the “Warranty Period”), except as provided below with respect to our roof penetration warranty. During the Warranty Period we will, at our expense, repair or replace any material or Work covered under this Agreement. Our Workmanship Warranty includes but is not limited to the following: (i) Roof Penetration Warranty. We warrant that roof penetrations made by the Solar System and impacting the Home’s roof will be weather-tight for a period of 10 years after installation.
Workmanship Warranty. Contractor warrants and represents that all services and Deliverables shall meet the completion criteria set forth in the Contract or any relevant Transaction Document, and that each of Contractor's services shall be performed in a professional and workmanlike manner in accordance with the highest applicable industry standards and according to its current description (including any completion criteria) contained in this Contract, an attachment, or a Transaction Document. A claim that specific services provided by Contractor did not meet the “highest applicable professional standards” must be made by ITS within ninety (90) days after the date on which the breach occurred. In the event that there has been a breach of the foregoing warranty and the Transaction Document does not provide a specific remedy for the breach of that warranty, ITS’ remedies under this warranty will be: (1) cure by Contractor within a reasonable time, not to exceed thirty (30) days, at no charge to ITS; and (2) if Contractor does not cure within the thirty (30) day period, ITS will be entitled to a refund of the amounts paid to Contractor for the service or part thereof that gave rise to the claim. This warranty is in addition to, and not in lieu of, any other warranty under this Contract or other remedies that may be provided in a Transaction Document under this Contract. In addition, the foregoing does not limit ITS’ right to seek additional remedies against Contractor for any damage caused by Contractor to hardware or other products acquired under this Contract (for example, damages incurred by ITS as a result of hardware being rendered unusable).
Workmanship Warranty. We warrant our Work and the Solar System for a period of twenty-five (25) years after installation (the “Warranty Period”), except as provided below with respect to our roof penetration warranty. During the Warranty Period we will, at our expense, repair or replace any material or Work covered under this Agreement. Our “Workmanship Warranty” includes but is not limited to the following:

A claim that specific services provided by Contractor did not meet the “highest applicable professional standards” must be made by ITS within ninety (90) days after the date on which the breach occurred. For purposes of the Contract, “highest applicable industry standards” shall be defined as the degree of care, skill, efficiency, and diligence that a prudent person possessing technical expertise in the subject area and acting in a like capacity would exercise in similar circumstances.
Workmanship Warranty a. Commencing on the Final Completion Date and for a period of one (1) year thereafter, Contractor warrants that the Systems will be free from defects (“Workmanship Warranty”). If a System has a defect, and County provides written notification of said defect within the one (1) year workmanship warranty period, Contractor will, with County’s written approval either repair or replace the portion of the System that is defective at no cost to County within forty-five (45) days of notification. The Workmanship Warranty shall not apply to the extent such defect is caused by any of the following: b. Alterations or repairs made to the supporting structure of any System or associated wiring and parts without Contractor's prior written approval; c. Failure of a System to perform caused by legislative, administrative, or executive regulation, order or requisition of the government, local utility or public utilities commission, or any state, provincial or municipal government or official; d. Use of a System beyond the scope contemplated in its operating manuals or technical specifications; e. Damage to a System not caused directly or indirectly by Contractor or its subcontractors under any agreement between Contractor and County; f. Force Majeure Events; g. A change in usage of that portion of the Site on which the System is located which may affect building or site permits and related requirements, without the written approval of Contractor, or a change in ownership of building or property and the new owner has not signed an assumption agreement of the terms and conditions herein, h. Any defect of deficiency to the extent the same results from a specific written direction from the County if, prior to implementing such written direction, Contractor advised County that County’s written direction would so affect the warranty provided by Contractor hereunder.
Workmanship Warranty. In addition to any warranties set forth in the Contract, Contractor warrants to Customer that all Work shall be performed in a good and workmanlike manner, of good quality, free from faults and defects and in conformance with the Contract and any associated design documents. The foregoing warranty shall be limited to defects in workmanship within the scope of work performed by Contractor and which arise and become known and for which notice is given to Contractor within one year from the date of substantial completion. Any defects arising after such one year are not warranted by Contractor.
Workmanship Warranty. All product(s) have a 90-day installation workmanship war- ranty effective upon day of installation. After 90 days Seller will charge and Buyer will pay a labor fee, trip fee, and materials fee to inspect a product(s) in need of repair. Any installation concern must be reported within the 90-day window from the completion of installation in order to be eligible for the appli- cation of this warranty. Manufactured panels are warranted for 20 years assuming regular care and maintenance. Any manu- factured panel concerns must be reported within the 20-year window in order to be eligible for application of this warranty. Seller is not liable for, and the warranty will not apply to, any damages as a result of any inclement weather, misuse of the product(s), unlevel lots, and customer modifications.
Workmanship Warranty. The Contractor warrants and represents that all Services provided by the Contractor and its subcontractors under the Agreement will be performed in a professional and workmanlike manner, in accordance with the highest applicable industry standards. Contractor warrants each of the Contractor’s employees and agents assigned to perform Services under this Agreement have the proper skills, training and background (core competencies) so as to be able to perform the Services in a competent and professional manner. For purposes of the Agreement, “highest applicable industry standards” shall be defined as the degree of care, skill, efficiency, and diligence that a prudent person possessing technical expertise in the subject area and acting in a like capacity would exercise in similar circumstances. The State will notify Contractor of any Services warranty deficiencies within ninety (90) calendar days from performance of the Services that gave rise to the warranty claim.
Workmanship Warranty. The Contractor warrants that all materials to be incorporated and all work performed shall be free of defects and shall meet all relevant standards of merchantability for the purposes intended. The Contractor shall keep the Project area clean and orderly during the course of the work and remove all debris upon completion of work. Materials and equipment that have been removed and replaced as part of the work shall belong to the Contractor unless otherwise specified in writing by the Participant.
