Common use of Xx Waiver Clause in Contracts

Xx Waiver. The failure of any Party to insist upon or enforce strict performance by any other Party of any provision of this Agreement or to exercise any right under this Agreement shall not be construed as a waiver or relinquishment to any extent of such Party’s right to assert or rely upon any such provision or right in that or any other instance; rather the same shall be and remain in full force and effect.

Xx Waiver. The failure of any Party a party to insist upon or enforce strict performance by adherence to any other Party of any provision term of this Agreement or to exercise on any right under this Agreement occasion shall not be construed as considered a waiver or relinquishment to any extent of such Partyparty’s rights or deprive such party of the right thereafter to assert or rely insist upon any such provision or right in strict adherence to that term or any other instance; rather the same shall be and remain in full force and effectterm of this Agreement.

The Any failure by either party on any occasion to enforce or require adherence to any term or condition of any Party to insist upon or enforce strict performance by any other Party of any provision of this Agreement or to exercise any right under this Agreement shall not be construed as constitute a waiver of any such term or relinquishment condition, and shall not prevent that party from insisting on the strict adherence to any extent and performance of such Party’s right to assert term or rely upon any such provision or right in that or condition on any other instance; rather the same shall be and remain in full force and effector future occasion.
