Xxxxx Street. One year after the date a certificate of occupancy is issued for Building One, appropriate paving, landscaping, lighting, controls, and other improvements required to ensure a safe, comfortable crossing of the CN railroad tracks for both motorized and non-motorized users, in compliance with current industry standards. The RDA and/or City shall take steps in accordance with all applicable codes and ordinances to rename the segment of Xxxxx Street east of Broadway to a new name agreeable to the parties.

Xxxxx Street. The City agrees to vacate the entire Xxxxx Street within the Riverfront Site (generally east of the City Parcel to the Maumee River) and to convey to ProMedica, without fee or charge, one-half of the vacated Xxxxx Street with the exception of the area of the community walkway along the Maumee River. ProMedica will convey to the City, without fee or charge, (i) the portion of the vacated Xxxxx Street within the area of the community walkway along the Maumee River. Approximately Thirty (30) feet of the north side of the vacated Xxxxx Street shall be vested in and owned by the City to provide access to the Imagination Station and to provide pedestrian access from Summit St. to the River.
