XXXXXXXXX TO EXECUTIVE DIRECTOR. If the aggrieved employee and his/her department head cannot reach an agreement as to a solution of the grievance or the employee has not received a decision from the department head within the aforesaid five (5) working day limit, the employee may, within five (5) working days, following the termination of the procedures described in Section 8.5(c) present his/her grievance in writing to the Executive Director or his/her designee, with a copy to Human Resources. Within five (5) working days of the receipt of such grievance, the Executive Director or his designee will arrange a meeting with the aggrieved employee and the aggrieved employee's representative, at a mutually agreeable location and time to discuss the grievance. The Executive Director or his/her designee may invite other members of management to be present at this meeting. The Executive Director or his/her designee will issue a written decision within five (5) working days following the date of the aforesaid meeting.

XXXXXXXXX TO EXECUTIVE DIRECTOR. If the supervisor fails to resolve the matter to the employee’s satisfaction, and if the employee desires to pursue the grievance further, the employee or his/her representative shall, within fifteen (15) days of the date of receipt of the supervisor’s response to the grievance, file a written notice of grievance with the Executive Director’s designee. This writing will specify the specific provisions of the Agreement that are alleged to be violated, the basis for the belief that the Agreement has been violated and the proposed terms of resolution. The designee shall investigate the grievance and consult with appropriate MainePERS officials to determine the employer’s response. The designee may meet with the employee and/or the employee’s representative as part of the investigation. Within fifteen (15) days of the grievance notice, the designee shall provide the employee with the employer’s written response.
