This supplement to the MFS 403(b) Mutual Fund Custodial Agreement1 (the “Agreement”) describes changes affecting 403(b) plans and custodial accounts made by the Setting Every Community Up for Retirement Enhancement Act of 2019 (the “SECURE Act”) and the Coronavirus Aid, Relief, and Economic Security Act (the “CARES Act”) which were recently enacted. The Agreement will be amended to incorporate the SECURE Act and CARES Act changes once future guidance is issued by the Internal Revenue Service. In the interim, this supplement is provided to inform you of the changes. All capitalized terms not defined in this Supplement shall have the meaning assigned to them in the Agreement.
