This Agreement by and among the business entity indicated on the Merchant Application and its accompanying documentation, which documents are incorporated herein and constitute a part of this Agreement as if fully set forth herein (“Merchant” or “you”), National Processing Company, a Nebraska corporation (“NPC” or “us” or “we”), and the financial institution indicated on the Merchant Application (“Member Bank”) is binding on you as of the earlier of the date signed by NPC, the date of the first electronic transaction processed under this Agreement, or the date we approve your Merchant Application.
