to the agreement to sell, and claiming to be joint owner of the sub- ject-matter of the suit, is not entitled to be impleaded as a defen dant. He is neither a necessary nor a proper party and we fully agree in this view and answer the question posed at the threshold in the negative. We further hold that the decisions in Gurdev Singh and another v. Paras Ram, and another, (21) and Atul Sharma v. Gurvinder Singh and others, (22), do not lay down the correct law and are overruled. No costs.
