This Agreement is entered into by and between the Merchant and Provider. As used in this Agreement, the term “Provider” also shall include Provider’s agents, servicers and any assignee of this Agreement. “Customer” means clients of Merchant who wish to purchase goods or services using financing made available through Merchant and Provider. Each of Provider and Merchant are, from time to time, individually referred to herein as a “Party,” and collectively as the “P arties.” The “Effective Date” is the date on which Merchant becomes bound by this Agreement.
