In the event the conditions of the permit for GRA - are fully complied with and the Agreement executed by the undersigned in favor of City pertaining to said permit are fully performed, in compliance with all laws and regulations pertaining thereto, said sum is to be returned to the undersigned. Otherwise, City may, without notice to the undersigned, cause all of the work required to fulfill all of the conditions and provisions of said permit and the Agreement to be done and completed at the sole cost and expense of the undersigned, and for such purpose may use all or any part of said sum and may apply from said sum sufficient funds to pay all of the costs and expenses in connection therewith, including, but not limited to, City’s costs in furnishing its equipment and employees, its overhead expenses, and for any reasonable attorneys’ fees incurred in any legal action arising out of the Agreement.
