This Amended and Restated Public Improvement District Development and Financing Agreement (this "Agreement"), dated September 20, 2016, is made and entered into by and between the City of Forney, Texas (the "City"), a home-rule municipal corporation, acting by and through its City Manager, and Bleriot Forney #1, Ltd., a Texas limited partnership (the "Owner''). This Agreement amends and restates the Original Agreement (as defined below). The City and the Owner are sometimes each referred to herein as a "Party," or collectively as the ''Parties."
