THIS DEVELOPMENT AGREEMENT (“Agreement”) is entered into this day of , 2018, by and between the CITY OF DAVIS, a municipal corporation (herein the "City"), Binning Ranch Holding Company LLC, a California Corporation (“Landowner”) and J. David Taormino, an individual (“Developer”). This Agreement is made pursuant to the authority of Section 65864 et seq. of the Government Code of the State of California. “Developer” shall include Landowner until Landowner is released from obligations as provided for herein. This agreement refers to the City and the Developer collectively as the “Parties” and singularly as the “Party.”
