The Health and Human Services Commission (“HHSC” or “Owner”) and Berry and Clay, Inc. (“Construction Manager-at-Risk” or “Construction Manager”) entered into that certain Contract for Pre-Construction Services and Construction Services that was effective August 3, 2021 and denominated as HHSC Contract No. HHS000942200001 (the “Contract”). HHSC and Construction Manager at Risk are collectively referred to herein as the “Parties”; the Parties now desire to amend the Contract.
