The Bangor School Department (District) voluntarily agrees to take the following actions to resolve the above-referenced complaint as investigated by the U.S. Department of Education’s Office for Civil Rights (OCR). OCR investigated this complaint pursuant to its jurisdiction under Section 504 of the Rehabilitation Act of 1973 and its implementing regulation at 34 C.F.R. Part 104 (Section 504) and Title II of the Americans with Disabilities Act of 1990 and its implementing regulations found at 28 C.F.R. Part 35 (Title II).

Wayne County Community College District (the College) agrees to resolve the allegation of discrimination on the basis of disability contained in complaint number 15-15-2219 filed with the U.S. Department of Education, Office for Civil Rights (OCR). The College submits this Resolution Agreement (Agreement) to ensure compliance with the requirements of Section 504 of the Rehabilitation Act of 1973 (Section 504), as amended, 29 U.S.C. § 794, and its implementing regulation at 34 C.F.R. Part 104, and Title II of the Americans with Disabilities Act of 1990 (Title II), 42 U.S.C. § 12132, and its implementing regulation at 28 C.F.R. Part 35. This Agreement has been entered into voluntarily and does not constitute a finding or an admission that the College is not in compliance or has failed to comply with Section 504 or Title II and their implementing regulations and cannot be used to establish any wrongdoing by the College. The College agrees to take the following actions:

The U.S. Department of Education, Office for Civil Rights (OCR), initiated the above-referenced investigation of the Birmingham City School District (District), pursuant to Section 504 of the Rehabilitation Act of 1973 (Section 504), as amended, 29 U.S.C. § 794, and its implementing regulation, 34 C.F.R. Part 104, and Title II of the Americans with Disabilities Act of 1990 (Title II), 42 U.S.C. §§ 12131 et seq., and its implementing regulation, 28 C.F.R. Part 35, which prohibit discrimination on the basis of disability. The Birmingham City School District (District) has voluntarily entered into this Resolution Agreement (Agreement).
