Conservation Easements: An Option for Preserving Current Land Uses1
Conservation Easement Agreement • June 4th, 2013

Conservation easements are cost-effective means for government agencies or non-government conservation organizations to protect land. Instead of purchasing land outright, these agreements allow organizations to purchase the development rights of a property, thereby protecting the target resources and saving money. Conservation easements may be a viable option for landowners wanting to prevent future residential and commercial development of their land, and those who want to reduce their heirs’ inheritance tax liability. They often work best for landown- ers who have a strong connection to their land and want to ensure its protection for many generations. Conservation Easement Agreement • September 9th, 2014

The Town of Bethlehem Conservation Easement Agreement program is an open space tool to conserve open space lands, maintain the character of the Town, and provide financial incentives and assistance to those landowners choosing to maintain their land as open space. Property owners who commit to conserving land as open space for a minimum of 15 years can receive an exemption on their property assessment resulting in a reduction in property taxes, under such conditions as may be specified within a conservation easement agreement with the Town. While conserving developable lands is a key component of the program, constrained lands which may include, but not be limited to, wetlands, steep slopes, water bodies, etc. are also highly valued for their contribution of habitat for wildlife.

CONSERVATION EASEMENTS:
Conservation Easement Agreement • May 13th, 2015

A conservation easement is a voluntary legal agreement between the owner of a property and at least one other party who “holds” the easement. Typically, the easement would be held by a land trust, but might also be held by a municipal government or a conservation authority. The agreement places specific restrictions on the use and development of the property for the purpose of preserving its heritage features. These features may include built heritage (like a historical building), recreational heritage (like the Bruce Trail), cultural heritage (like an archeological site), or natural heritage. As stewards of our lake, we would naturally be most concerned with natural heritage features such as wildlife habitat, forests, wetlands and undisturbed shoreline.
