This Agreement specifies the terms and conditions under which Pender County Geographic Information System (GIS) digital data and/or digital data products shall be used where those data products have been provided through a GIS Data Distribution Agreement with Pender County at the cost defined on either the “Pender County Fee Schedule” or in the case of custom projects, on the “Bill” provided with the GIS Product. In addition, the data user will not resell or otherwise use Pender County GIS data for commercial or trade purposes except as allowed by NC Public Records Law (NC GS 132‐10). Digital data products are distributed through the GIS Division of the Pender County Information Technology Services Department located at 805 S Walker St in Burgaw, NC 28425.

This Agreement specifies the terms and conditions under which eThekwini Municipality’s GIS digital data and/or digital data products shall be used where such data has been provided through a GIS Data Distribution Agreement with eThekwini Municipality as provided in the GIS Policy and Procedures (Section 5.1). Digital data products are distributed through the different departments of the Municipality, however the Municipality shall remain the custodian of such data sets and the Corporate GIS Department of the Office of the City Manager has been entrusted with all GIS responsibilities including but not limited to ownership, maintenance and distribution.
