Under the Contract, Claimant ceded its claims resulting from and / or relating to the infringements established by the European Commission in its decisions of 19 July 2016 and 27 September 2017 in case AT.39824 – Trucks to Sophokles (Sicherungsabtretung) (“Claims”). The Claimant authorised Sophokles to cede the Claims to third parties, in particular a financing partner (“Financing Partner”). Sophokles granted Claimant the right to collect proceeds from the Claims (“Einziehungsermächtigung”), and the right to take, in the Claimant’s name, legal action for enforcing the Claims (“Prozessführungsbefugnis”).
