This MUTUAL CONFIDENTIALITY AGREEMENT (“Agreement”) is entered into as of this day of , 2022, between , (“Counterparty”), with an address at and Duke Energy Indiana, LLC (“Duke Energy Indiana”) having its headquarters and principal place of business in Plainfield, Indiana. Duke Energy Indiana and the Counterparty shall sometimes be individually referred to herein as a “Party” and collectively as “Parties.” For the purposes of this Agreement, when the term Party is used with respect to Duke Energy Indiana, it shall also include all subsidiaries and affiliates of Duke Energy Indiana.
