A Force Majeure Event definition

A Force Majeure Event means any event preventing the performance of any provision of this Agreement arising from or attributable to acts, events, omissions or accidents that are beyond the reasonable control of the parties, such as (without limitation) any abnormally inclement weather, fire, explosion, earthquake, subsidence, structural damage, epidemic or other natural physical disaster, failure or shortage of power supplies, military operations, public disorder, industrial action, act or threatened act of terrorism and/or any legislation, regulation, ruling, decision or omission (including failure to grant any necessary permissions) of any relevant authority, including any court, government agency or governing body
A Force Majeure Event means an event beyond the control of a party (or any person acting on its behalf), which by its nature could not have been foreseen by such party (or such person), or, if it could have been foreseen, was unavoidable, and includes, without limitation, acts of God, storms, floods, riots, fires, sabotage, civil commotion or civil unrest, interference by civil or military authorities, acts of war (declared or undeclared) or armed hostilities or other national or international calamity or one or more acts of terrorism or failure of energy sources.
A Force Majeure Event means an event beyond the direct control or influence of a party, including any of the following: (a) act of God, fire, flood, earthquake, cyclone, tornado, hurricane, epidemic, landslide, lightning, induction caused by lightning or other declared natural disaster; (b) government orders or court orders; (c) war (whether declared or not), sabotage, riot, insurrection, national emergency (whether in fact or law), martial law or civil disturbances; (d) maintenance, outage or breakdown at a power station or distribution or transmission system which reduces the supply of electricity; or (e) third party industrial action such as strikes, lockouts, work stoppage, labour disputes and protests (but excluding any such action involving the agents, employees, contractors, nominees or other like persons of the party claiming relief); which causes the party claiming the relief to be unable to perform its obligations under the Contract (other than an obligation to pay money) and which could not have been prevented by that party exercising a standard of care and diligence consistent with that of a prudent person undertaking that party's obligations under the Contract.

Examples of A Force Majeure Event in a sentence

  • A Force Majeure Event does not include an act of negligence or intentional wrongdoing.” For the purposes of this article, this definition of Force Majeure shall supersede the definitions of Force Majeure set out in Section 32.10.1 of the ISO OATT.

  • A Force Majeure Event may arise due to causes and events out of Homefield Energy’s reasonable control, including but not limited to acts of God; acts of any governmental authority; accidents; strikes; labor disputes; required maintenance work; inability to access DSP’s system; and non-performance by your DSP.

  • A Force Majeure Event shall not constitute a breach of the contract.

  • A Force Majeure Event will not give rise to any cause of action or liability based on default of the provision that the party has failed to comply with or observe due to the Force Majeure Event.
