Any notice definition

Any notice given to either party shall be in writing and shall be deemed to have been given when delivered personally or sent by certified or registered mail, postage prepaid, return receipt requested, duly addressed to the party concerned, if to the Company, at its principal office, and, if to the Executive, at the address of the Executive shown on the Company's records, or at such other address as such party may give notice of.
Any notice given in accordance with the provisions of this paragraph shall be deemed given when the primary notice is actually delivered or when proper delivery of the primary notice is refused, without regard to the date on which any copy is delivered or proper delivery thereof is refused. Any notice (primary or copy) given to an entity shall be deemed to be delivered on the date such notice is received or proper delivery is refused by the entity, without regard to when such notice is delivered by the entity to the individual to whose attention it is directed and without regard to the fact that proper delivery is refused by someone other than the individual to whose attention it is directed. Notices may be given on behalf of any party by such party's attorney(s).
Any notice given or correspondence with the Cardholder by post shall be sent to the latest address provided by the Cardholder to the Bank in writing and shall be deemed to have received within 48 hours of posting.

Any notice given under this agreement shall, in the absence of earlier receipt, be deemed to have been duly given as follows: (A) if delivered personally, on delivery; (B) if sent by first class post, two clear Business Days after the date of posting; and (C) if sent by facsimile, when despatched provided a confirmation of successful transmission is produced by the sending fax machine.

Any notice given via United States mail shall be deemed effectively given two (2) days after mailing.
Any notice given pursuant to this Section 5 shall contain a certification by the sending party that a copy of such notice has been concurrently sent to the other party.
