Applicable Products definition

Applicable Products means all Products and/or Brands of a Participating Company for which the Participating Company is seeking a finding by the Association that such Products and/or Brands are produced in Compliance with the Fair Labor Association Standards.
Applicable Products means the Products referred to in clauses (a), (b) and (e) of the definition of Covered Revenues. If a Product that was a Bundled Product or Service ceases to be a Bundled Product or Service, then effective as of the date on which such Product ceases to be a Bundled Product or Service, it will not be an Applicable Product for any purpose under this CVR Agreement for so long as it is not a Bundled Product or Service and does not and would not generate Covered Revenues on a standalone basis.

More Definitions of Applicable Products

Applicable Products means Qsymia®, PANCREAZE®, VI-0106 and any new or additional products to be developed or acquired by VIVUS, the Company and the other Subsidiaries of VIVUS after the Effective Date; provided that if VIVUS, the Company and the other Subsidiaries of VIVUS cease to own the rights to Qsymia® or PANCREAZE® or any new or additional products to be developed or acquired by VIVUS, the Company and the other Subsidiaries of VIVUS after the Effective Date, such product shall cease to be an Applicable Product.
Applicable Products means (A) all products branded “Select” (“Select Products”) and all products containing more than 0.3% THC of processed cannabis (“THC Extracts”) and (B) ancillary devices (such as vape pen batteries, wholesale branded cartridges, etc.) that are sold as a package with Select Products or THC Extracts.

The individuals who comprise Customer’s Authorized Contacts can be subsequently modified – in writing or via email - by Customer upon approval by Dialogic. Electro-Static Discharge (ESD) Protection: Procedures followed and devices worn by anyone handling Dialogic hardware, in order to protect delicate electronic components from damage due to static electricity. Error Any verifiable and reproducible failure of the Software to substantially conform to the Specifications. The term “Error” will not include any failure of the Software to substantially conform to the Specifications that: (i) results from Customer’s improper use of the Software; (ii) does not materially affect the operation and use of the Software; or (iii) results from the modification by Customer of the Software not contemplated by this Agreement. Error Correction(s) A (i) modification or addition to or deletion from the Software, that, when made to the Software, materially conforms the Software to the Specifications, or (ii) a procedure or routine that (a) is mutually acceptable to both Dialogic and Customer in good faith, and (b) when observed in the regular operation of the Software eliminates the material adverse effect of such Error to Customer. Error Correction is at Dialogic’s sole discretion based on factors including but not limited to product life cycle stage and Error severity. Hardware Means the physical Applicable Product.
