Background Data definition

Background Data means Technical Data produced by Recipient at private expense prior to performance of or outside the scope of this Agreement and is considered by Recipient to be proprietary. Such Background Data may include any modifications, derivatives to previously conceived, designed, developed, and resultant revisions to software, processes, qualification data, and manufacturing plans.
Background Data as used in this clause, means limited rights data and restricted computer software owned or controlled by the Seller at any time through completion of the subcontract and developed outside the scope of this subcontract.
Background Data means all Data which has been captured, produced or otherwise developed independently of this Contract and made available by a Party for the Project, but does not include Third Party Data.

More Definitions of Background Data

Background Data means Technical Data and Information generated prior to or apart from this Contract or any Subcontract but directly utilised in the execution of the Work performed under this Contract or any Subcontract and necessary for the use, repair, or maintenance of any product actually delivered under this Contract.
