Background Invention definition

Background Invention means an Invention conceived and first actually reduced to practice before the Effective Date.
Background Invention means any invention of either Party conceived outside of this CRADA.
Background Invention means an invention conceived and reduced to practice or made the subject of a patent application in accordance with patent law in the United States, or in any other country or region, before the effective date of this CRADA.

  • Nothing in this CRADA shall be construed to grant a Party any rights in another Party’s Background Invention other than to use the Background Invention to fulfill the requirements of the SOW.

More Definitions of Background Invention

Background Invention means any invention, idea, concept, technique, discovery, improvement or innovation, other than a Subject Invention, whether or not patentable, which invention is incorporated or utilized in any work by Seller performed under this Order.
Background Invention means any invention made by Seller (or its subcontractors of any tier) prior to performance of the Project Agreement or outside the scope of work performed under the Project Agreement.
