The Issuer and the Borrower hereby further declare their understanding and intent that the benefit of such covenants touch and concern the Borrower’s fee interest by enhancing and increasing the enjoyment and use of the Property by Low Income Tenants, the intended beneficiaries of such covenants, reservations and restrictions, and by furthering the public purposes for which the Bonds were issued.
The Borrower hereby represents and warrants that the Property will be located entirely within the County of Boulder, Colorado as of the Completion Date.
Notwithstanding anything herein to the contrary, no Project Costs relating to the acquisition of the Property or any assets relating thereto (including, without limitation, rights and interests with respect to development of the Property) shall constitute “Qualified Project Costs” unless, at the time Bond proceeds are expended to pay such costs, the Borrower and the seller of such assets are not “related persons” as such term is defined in Section 147(a)(2)(A) of the Code.
The Borrower reasonably expects to complete the acquisition, construction and equipping of the Property and to expend the full amount of the proceeds of the Loan for Project Costs prior to the date which is 36 months after the Closing Date.
The Borrower shall pay all fees and charges incurred in connection with any such recording.
