Breaching Party definition
Breaching Party has the meaning set forth in Section 12.2.
Breaching Party means a party that is in Breach of Tariff, Part IV or Tariff, Part VI and/or an agreement entered into thereunder.

Examples of Breaching Party in a sentence
With respect to material breaches of any payment provision hereunder, the Breaching Party will have a period of [**] after such Breach Notice is provided to cure such breach.
If such breach is not cured within the applicable period set forth above, the Non-Breaching Party may, at its election, terminate this Agreement upon written notice to the Breaching Party.
