Business Associate Agreement or BAA means the satisfactory written assurance from a Business Associate to permit the Business Associate to create, receive, maintain or transmit PHI on behalf of a Covered Entity or Upstream Business Associate. A BAA, in part, establishes the Business Associate’s: permitted or required Uses and Disclosures of PHI; obligations to safeguard PHI; and facilitation of the rights of Individuals with respect to PHI.
