Examples of Buyer’s Discretion in a sentence
Any determination, decision or election that may be made by Buyer pursuant to this Section 4.6, including any determination with respect to a tenor, rate or adjustment or of the occurrence or non-occurrence of an event, circumstance or date and any decision to take or refrain from taking any action or any selection, will be conclusive and binding and may be made in Buyer’s Discretion and without consent from Seller except, in each case, as expressly required pursuant to this Section 4.6.
With respect to any Event of Default which requires a determination to be made as to whether such Event of Default has occurred, such determination shall be made in Buyer’s Discretion and Guarantor and Seller hereby agrees to be bound by and comply with any such determination by Buyer.
Any determination to be made as to whether such Event of Early Termination has occurred shall be made in Buyer’s Discretion and Seller and Guarantor hereby agrees to be bound by and comply with any such determination by Buyer.
