Casualty Amount definition

Casualty Amount means five hundred thousand Dollars (USD500,000) (or the equivalent in any other currency);

• Borrower shall promptly notify Lender in writing upon obtaining knowledge of (i) the institution of any proceedings relating to any Taking (whether material or immaterial) of, or (ii) the occurrence of any casualty, damage or injury to, the Property or any portion thereof, the restoration of which is estimated by Borrower in good faith to cost more than the Casualty Amount.

• Except upon the occurrence and during the continuance of an Event of Default, Borrower may settle any insurance claim with respect to Proceeds which does not exceed the Casualty Amount.

• If for any completed Restoration the cost of which exceeds the Major Casualty Amount, Tenant has not theretofore delivered same to the FCRHA, Tenant shall deliver to the FCRHA, within ninety (90) days of the completion of such Restoration, a complete set of “as built” plans in CADD format, together with a statement in writing from Tenant or its Architect that such plans are complete and correct in all material respects.

• Lender shall have the right to participate in and reasonably approve any settlement for insurance claims with respect to the Net Proceeds which in the aggregate are equal to or greater than the Casualty Amount.
