Each of the Coal Leases is in full force and effect, and has not been amended or modified from the copy of the Coal Lease provided to the Banks (if so provided), except for Permitted Modifications.
PNRC is not in default under either of the New Mexico State Coal Leases and, to PNRC's knowledge, no third party is in material default thereunder.
