Collateral Asset definition

Collateral Asset has the meaning specified in Annex C.
Collateral Asset means a commercial loan or bond (or Participation Interest therein) owned or, as set forth in Section 1.04, committed to be acquired or funded, by the Borrower.
Collateral Asset means (i) each Bank Loan (including a First Lien Bank Loan or Second Lien Bank Loan), Senior Secured Bond, Senior Unsecured Bond, Senior Subordinated Bond or Subordinated Bond in each case whether or not given credit in the Borrowing Base or having a positive Advance Rate, (ii) all Cash and Cash Equivalents owned by Borrower and (iii) any other financial assets of the Borrower of any kind.

Examples of Collateral Asset in a sentence

  • Nothing herein shall obligate the Document Custodian to review or examine the terms of any underlying instrument, certificate, credit agreement, indenture, loan agreement, promissory note or any other document contained in the Loan Files evidencing or governing any Collateral Asset to determine the validity, sufficiency, marketability or enforceability of any Collateral Asset (and shall have no responsibility for the genuineness or completeness thereof) or otherwise.

  • It shall not have or permit the formation of any Subsidiaries, except in connection with the receipt of equity securities with respect to a Collateral Asset, Eligible Investments or any exchange offer, work-out or restructuring of a Collateral Asset.

  • Each contribution shall either be made (a) in Cash, (b) by assignment and contribution of an Eligible Investment and/or (c) by assignment and contribution of an Eligible Collateral Asset.

  • The Borrower has acquired each Collateral Asset in the ordinary course of its business and has given fair consideration and reasonably equivalent value to the seller of each Collateral Asset in exchange for the purchase or contribution of each such Collateral Asset.

  • The Equityholder may, but shall have no obligation to, at any time or from time to time, make a capital contribution to the Borrower for any purpose, including for the purpose of curing any Default or Event of Default, curing any Borrowing Base Deficiency, enabling the acquisition or sale of any Collateral Asset or satisfying any conditions under Section 3.02.


More Definitions of Collateral Asset

Collateral Asset means each or any, as the context may require, of the Identified Assets and Additional Assets over which security is granted to secure Program Debt but excluding any Collateral Asset which has been sold and which no longer constitutes part of the security, in each case in accordance with this Agreement.
Collateral Asset means any loan, security, cash or other asset owned or held by the applicable Loan Party, in each case whether or not given credit in the Borrowing Base or having a positive Advance Rate.
Collateral Asset means each Proposed Collateral Asset for which the applicable conditions for the funding of an Advance to consummate the acquisition of such Asset in Section 3.02 have been satisfied (or waived), but in each case excluding each Collateral Asset that has been released from the Collateral in accordance with Section 5.02(e)(i).
Collateral Asset means the real estate and related improvements commonly known as Xxxxxxxxxx Xxxx Xxxxxxx, Xxxx Xxxxx, Xxxxx.
Collateral Asset means the real estate and related improvements commonly known as Town Center Plaza, Leawood, Kansas.
Collateral Asset or “Collateral Assets” means any one or more of the Senior Loan Collateral Assets and/or the Unencumbered Collateral Assets.
Collateral Asset means the real estate and related improvements commonly known as Landing at Tradition and more particularly described in Exhibit “A” to the Mortgage.
