Commercial Facility definition

Commercial Facility means the Commercial Facility made available under this Agreement as described in Clause 2.1 (Facility).

Commercial Facility means any facility that is used for retail stores, restaurants, office buildings, laundries, and other pri- vate business and service establishments or similar enterprises.

Commercial Facility means any structure or building, or any portion therefore, other than a residential dwelling.

• The Borrower shall on the Commercial Final Maturity Date repay to the Facility Agent as agent for the Commercial Facility Lenders, the Commercial Final Payment, together with all interest and all other amounts payable under this Agreement and the Facility Documents due to the Commercial Facility Lenders.

• Large Scale Industrial and Commercial Facility (LSICF) -- A large-scale industrial or commercial facility is defined as any industrial or commercial facility, including any associated facilities, which requires the mandatory preparation of an Environmental Impact Report (EIR) pursuant to the Massachusetts Environmental Policy Act (MEPA), specifically review thresholds sections 11.03(1)(a), and 11.03(3)(a) thru (9)(a).

• Subject to the terms of this Agreement, the Commercial Lenders make available to the Borrower, during the Availability Period-Commercial Lenders’ Guarantee, a guarantee facility in the amount of up to the Guarantee Facility Commitment (the “Guarantee Facility”) granted by the Commercial Lenders in the form of the Commercial Lenders’ Guarantee conditional upon the utilisation of the Eksportfinans Commercial Facility.

• The Dollar Commercial Facility and the Sinosure Facility bear interest at USD LIBOR plus applicable margins.
