Commercially Exploit definition

Commercially Exploit or "Commercial Exploitation" of a Licensed Product, shall mean to provide the Licensed Product to a customer, in exchange for valuable consideration.

Commercially Exploit or “Commercial Exploitation” means to make, have made, use, have used, import, export, and to sell, offer for sale or have sold a Product.

Commercially Exploit is to use, reproduce and modify Arising IP, and to manufacture, use, import, and sell articles embodying or made by use of any Deliverables and to provide services by the use of any Deliverables.

Examples of Commercially Exploit in a sentence

• USFRF will permit SWT to sublicense its rights to Commercially Exploit Licensed Products, provided that SWT pay royalties to USFRF as if SWT had Commercially Exploited Licensed Products sold by it's sublicensees which may have been granted sublicenses by SWT.

• Subject to USFRF's retained rights and covenants set forth in Section VIII below, SWT is granted the exclusive right and license to Commercially Exploit Licensed Products in the Territory.

• Licensee acknowledges and agrees that, prior to the Effective Date, Licensor, Licensee or Blue Planet Software, Inc entered into the license agreements listed on Appendix E, attached hereto (the “Existing Tetris License Agreements”) pursuant to which Licensor, Licensee or Blue Planet Software, Inc granted to certain licensees the right to Commercially Exploit the Licensed Properties on or in connection with various devices, including Mobile Telephony Devices.

• It is the responsibility of 22nd Century to obtain any licenses from third parties needed by 22nd Century to Commercially Exploit NRC’s Intellectual Property licensed to 22nd Century under this Agreement.

More Definitions of Commercially Exploit

Commercially Exploit means to sell, lease, offer or exhibit for sale or lease, or otherwise distribute for a commercial purpose;

Commercially Exploit means to sell, lease, of- fer or exhibit for sale or lease, or otherwise dis- tribute for a commercial purpose;

Commercially Exploit means (a) to use, reproduce and/or modify any Intellectual Property, (b) to grow, have grown, make, have made, manufacture, import, export, use, offer-to-sell, market, distribute, and sell articles embodying or made by use of any Intellectual Property, and/or (c) to license or sub-license the rights of (a) and (b) to do the same.

Commercially Exploit. Without limitation, to use, copy, produce, publish, reproduce, make, manufacture, sell, license, rent, loan, let for hire, distribute, package, market, promote, advertise, solicit orders for, merchandise, issue copies to the public, demonstrate, transmit or communicate in or to the public by telecommunication or any other means (such as interactive or non-interactive broadcasts via over the air, cable, satellite, Internet or otherwise), perform, show, display and exhibit (including perform , show, display and exhibit in public), import, bundle and otherwise commercially distribute and issue copies to the public by any means now known or hereinafter developed and authorize other persons to do any or all of the foregoing.

Commercially Exploit means to promote, market, sell and/or otherwise generate income from the Product.

Commercially Exploit. (and variants thereof such as “Commercially Exploiting” and “Commercial Exploitation”) shall mean, as to Adapted Games that are resident on a Mobile Telephony Device or remotely accessed through a Mobile Telephony Device, to make, import, use, reproduce, market, advertise, promote, distribute, sell, exploit, publicly display, publicly perform, prepare derivative works of, license, grant subscriptions to, sublicense or otherwise exploit such games, whether directly or indirectly through a third party acting on Licensee’s behalf, on a revenue-generating basis.

Commercially Exploit means in relation to any technology to make Improvements to and to market, distribute and grant sub-licenses to use the technology in conjunction with the Improvements and to reproduce the technology for these purposes.
