Company Activities definition

Company Activities means the business of construction and maintenance of railway beds and tracks; construction and maintenance of elevated rail systems and structures; construction and maintenance of railway switching and signaling equipment, distributorships and supply in the field of rail and railway construction materials; distributorships and supply in the field of electromechanical controls for use in the railroad industry, namely, railway switching equipment and railway signaling equipment; and design for others in the field of railroad industry, namely, engineering design of rail and railway related structures and equipment or any other business of the Employer and its consolidated (for financial accounting purposes) subsidiaries (the "Consolidated Group") which said entities are engaged in on the Termination Date as long as such business generated gross sales of at least 10% or more of the total gross sales of the Consolidated Group for the most recent fiscal year of the Employer before or on the Termination Date.
Company Activities means the business of selling caller ID technology and hardware, fulfillment services, e-commerce fulfillment and e-commerce return services as well as other similar services that Innotrac or its subsidiaries is involved in at the date of this agreement.
Company Activities means either (i) manufacturing, distributing, designing, selling or installing sports equipment and related parts or supplies or (ii) engaging in any other business activities which are conducted, offered or provided by Seller, Parent or any of their respective Subsidiaries or Affiliates of either of them at any time during the 12-month period prior to the date of this Agreement.

Company Activities means manufacturing, distributing, designing, selling or installing sports equipment or sporting goods or related parts or supplies that are competitive with those manufactured, distributed, designed, sold or installed by Buyer, the Company or their Affiliates.
