To the Company’s Knowledge, no such Company Software contains “back door,” “time bomb,” “Trojan horse,” “worm,” “drop dead device,” “virus” or other software routines or hardware components that permit unauthorized access or the unauthorized disablement or erasure of Company Products or Services (collectively, “Contaminants”), and the Company and the Company Subsidiaries have taken all commercially reasonable steps to prevent the introduction of Contaminants into Company Products or Services.
The Company Group has not received any written notice, and no Action or proceeding has been instituted, settled or, to the Knowledge of the Company, threatened that (i) alleges any such infringement, dilution misappropriation or other violation or (ii) challenges the validity or enforceability of any Company Owned Intellectual Property or the Company's right to use or otherwise exploit any Company Intellectual Property or Company Products or Services.
If a claim under Section 10.1 above appears likely, then the Company may modify the Company Products or Services, procure any necessary license, or replace the affected item with one that is functionally equivalent.
The Company has a policy and procedure for tracking material bugs, errors and defects of which it becomes aware in any Company Products or Services, and maintains a database covering the foregoing.
The Company has complied with all contractual obligations and Applicable Law relating to (a) the privacy of users of the Company Products or Services and all Company Websites, and (b) the collection, storage and transfer of any personally identifiable information collected by the Company or by third parties having authorized access to the Company’s records.

The Company does not provide any guaranty, warranty or other indemnity for the Company Products or Services, beyond the applicable standard terms and conditions of sale or lease for a period greater than five years including any liability as a result of field and epidemic failures.
No Platform has given the Company or any of its Subsidiaries written notice that it intends to stop or materially alter its business relationship with the Company or any of its Subsidiaries (whether as a result of the consummation of the transactions contemplated by this Agreement or otherwise), or has during the past twelve (12) months threatened in writing to decrease or limit materially, the processing of in-app purchases for the Company Products or Services.
Refunds shall be issued to the credit or debit card used in connection with registering Your Account or purchasing any Company Products or Services; it should take between seven (7) and fourteen (14) business days for the credit to appear in your account.
During the term of this Agreement, the Service Provider may indicate that it is an authorized Service Provider of and may use the trademarks, service marks, logos, symbols, and trade names of the Company applicable to the Company Products or Services in connection with Service Provider’s delivery of assignment in accordance with the terms of this Agreement.
