Competitive Territory means the United States of America, Great Britain, Belgium, Germany, Japan, China and any other nation in which, to the knowledge of Employee, the Company has made or considered making such sales, either itself or through a subsidiary, affiliate or joint venture partner, during the last two years prior to the termination of Employee’s employment hereunder.
Competitive Territory means the territory collectively covered by the On-Premise Distribution Agreement/s with AB/Hansen Distributors that are in effect on the date the particular event specified in Section 12.2(b) occurs; provided, however, that the Competitive Territory shall not include (a) any territory covered by a On-Premise Distribution Agreement/s in which Hansen has distributed to On-Premise Accounts through means other than an AB/Hansen Distributor more than one-third (1/3) of the cases of Products sold in such territory during the shorter of (I) the 12-month period immediately preceding the date of any such event, or (II) the period commencing on the Effective Date and ending on date of any such event, or (b) any territory in which Hansen is a party to a Competitive Agreement that is in effect on the date Hansen and one or more AB/Hansen Distributors enter into a On-Premise Distribution Agreement/s relating to On-Premise Accounts in all or some of that territory.
Competitive Territory means the territory collectively covered by all Distribution Agreement/s with AB/Xxxxxx Distributors that are in effect on the date any particular event specified in Section 9.1(b), Section 9.1(c), or Section 14.2 occurs; provided, however, that the Competitive Territory shall not include (a) any territory covered by a Distribution Agreement in which Xxxxxx has distributed to retail through means other than an AB/Xxxxxx Distributor more than one-third (1/3) of the cases of Products sold in such territory during the shorter of (I) the 12-month period immediately preceding the date of any such event, or (II) the period commencing on the Effective Date and ending on the date of any such event, or (b) any territory in which AB is a party to a Competitive Agreement that is in effect on the date Xxxxxx and one or more AB/Xxxxxx Distributors enter into a Distribution Agreement covering all or some of that territory.
Examples of Competitive Territory in a sentence
Licensor's right to license, develop, own or operate a Hard Rock Hotel with a casino or a Hard Rock casino within the Competitive Territory during the term of this Agreement shall be subject to the restrictions set forth in Section 17(B) hereof.

Competitive Territory means the geographic region depicted on the map attached hereto as EXHIBIT F and made a part hereof, which shall include the cities of Biloxi, Gulfport and Bay of St. Louis.

Competitive Territory means the United States of America, Great Britain, Belgium, Germany, Japan, China, and any other nation or location in which Calgon has made, or considered making, such sales, either itself or through a subsidiary, affiliate, or joint venture partner, during the last two years prior to the termination of Ball’s employment and/or during that three-year period applicable to this provision. Prior to accepting employment, or service or appointment to any of the above-enumerated positions, during the three-year period set forth above, Ball shall notify Calgon in order for Calgon to determine if the position that Ball is considering violates this Agreement. The decision of Calgon in these regards shall be considered final and binding.
