Compliance Procedure definition

Compliance Procedure means any proceedings instituted pursuant to the Hazardous Waste Management Act, chapter 70.105 RCW, and Hazard- ous waste fees, chapter 70.105A RCW, or regulations issued under au- thority of state law, which seeks to require compliance, or which is in the nature of an enforcement action or an action to cure a viola- tion. A compliance procedure includes a notice of intention to termi- nate a permit pursuant to WAC 173-303-830(5), or an application in the state superior court for appropriate relief under the Hazardous Waste Management Act. A compliance procedure is considered to be pending from the time a notice of violation or of intent to terminate a permit is issued or judicial proceedings are begun, until the department no- tifies the owner or operator in writing that the violation has been corrected or that the procedure has been withdrawn or discontinued.
