Concealed Conditions definition

Concealed Conditions means subsurface or otherwise concealed physical conditions at the Premises that differ materially from the Documented Site Conditions or those conditions ordinarily expected to exist at a site like the Property and generally recognized as inherent in construction activities of the type and character as the work to be performed by Lessee under this Lease, and that Lessee could not have otherwise discovered through the exercise of reasonable diligence in advance of commencing its performance of its obligations at the Premises.
Concealed Conditions means subsurface or otherwise concealed physical conditions at the Site of an unusual nature that differ materially from those conditions ordinarily found to exist and generally recognized as inherent in construction activities of the type and character as the Work, and that the Contractor could not have discovered through the exercise of reasonable diligence during the performance of the Investment Grade Audit.
Concealed Conditions shall have the meaning given to such term in Section 7.1.2.

More Definitions of Concealed Conditions

Concealed Conditions means subsurface or otherwise concealed physical conditions on the Premises of an unusual nature that differ materially from those conditions ordinarily found to exist and generally recognized as inherent in the Work anticipated by this Contract, and that the ESCO could not have anticipated based upon experience or discovered through the exercise of reasonable diligence prior to completion of the Investment Grade Audit.

Any condition requiring additional labor, equipment, and/or materials to complete the drilling or concrete operations will require a Change Order before Company will complete the process. Price quotes are based on a drilled pier footing. Any variation will incur additional charges (i.e. spread footings, concrete mat, sand, water, landfill, etc.). Costs for footing and installation do not include any allowance for extending below frost lines (the additional costs for which vary by geographical region)
