If the Project Company fails to achieve the COD by the SCOD (other than due to a Buyer Failure, a Buyer Risk Event or a Force Majeure Event), the Project Company will be liable to pay OPWP liquidated damages at the rate of seventy-five Rial Omani (RO 75) per MW of Guaranteed Contracted Power Capacity for each day by which the COD is delayed beyond the SCOD.
