After the expiration of each Operational Year, Landlord shall furnish Tenant with a written statement prepared by Landlord of the actual Cost of Operation and Maintenance incurred for such Year (“Actual Costs”).
They will be compared to conventional trucks of the same vehicle class, making them ready to enter the market in 2029 with equal Total Cost of Operation (TCO) as 2020 engine-based solutions, assuming a production volume of more than 10,000 vehicles/year.
Before entering into price negotiations provided by this paragraph, and before selecting a method of compliance that results in the increased Cost of Operation, the Contractor shall consult with and receive approval from the CVWMA of a plan and cost impact statement describing various alternative methods of compliance with new State or federal legislation and justifying the selected method of compliance as the most appropriate alternative.
Beginning on the Commencement Date, Tenant shall pay to Landlord as Additional Rent, Xxxxxx’s Estimated Share of the Cost of Operation and Maintenance falling wholly or partially within the Term of this Lease, in monthly installments.
