Custody Assets definition

Custody Assets means as defined in Section 15.2 of these Terms;
Custody Assets means, as of any time, all of the Accounts, cash, cash equivalents, Chattel Paper, Deposit Accounts, Documents, Financial Assets, Financial Contracts, General Intangibles, Instruments, Investment Property, Money, Supporting Obligations in respect of the foregoing and Proceeds of all of the foregoing, in each case that, at such time, are in the Custody Account.
Custody Assets. ’ shall mean assets held in the Custody Account on behalf of the Client, which are arranged to be held in safe custody

Examples of Custody Assets in a sentence

  • In the event that ETANA is under any obligation (whether from a governmental or private action such as a levy, forfeiture order, or other legal obligation) to pay the same on behalf of the Client, it may do so without Instructions from the Client, firstly by debit to the fiat position, and to the extent of any deficiency in the fiat position, out of the remaining Custody Assets.

  • ETANA is not acting under this Agreement as manager or investment adviser to the Client, and responsibility for the selection, acquisition and disposal of the Custody Assets remains with the Client at all times.

  • ETANA will provide the Client or its authorized agent with periodic reports and/or transaction statements of accounts relating to the Custody Assets on a quarterly basis, the level of detail of which will be agreed in writing between ETANA and the Client from time to time.

  • Failing timely transfer by the Client of the fees and expenses as aforesaid, ETANA has, without prejudice to any other of its rights hereunder or otherwise, full and irrevocable authority first to debit the Client’s fiat position, and second, to the extent of any deficiency remains after debiting the Client’s fiat position, the remaining Custody Assets.

  • Client understands and agrees that the selection of Custody Assets from the Custody Account for liquidation shall be at the sole discretion of ETANA.


More Definitions of Custody Assets

Custody Assets means as defined in Clause 15.2 of these Terms;
Custody Assets means Securities, investments and any other other assets (whether trangible or intangible) held or received by us for your Account, and, for the avoidance of doubt, shall include any non-currency Margin;
Custody Assets when used in the Agreement and/or any agreements by and between us, including, without limitation, these Terms and Conditions, unless the context otherwise requires, shall mean any shares, stocks, debentures, bonds, securities, or other similar property (including evidence of or title to Securities and all rights in respect of Securities) deposited or transferred by the client or on the client’s behalf with or to us or with or to our sub-custodian or collected by us or by our sub-custodians for the client’s Account;
Custody Assets has the meaning given to it in clause 20.1 of these Terms;
Custody Assets means assets held in the Custody Account on behalf of the Client, which are arranged to be held in safe custody.
Custody Assets means your securities or other assets in respect of which we (a) act as a custodian; or (b) arrange for a third party to act as a custodian;
Custody Assets has the meaning ascribed thereto in clause 2.2; “Instructions” has the meaning ascribed thereto in clause 3.2;
