Declarant Control Period definition

Declarant Control Period means the period of time during which Declarant holds a fee interest or contractual right in any portion, however small, of the land described in Exhibit A and/or Exhibit B attached hereto and incorporated herein.

Examples of Declarant Control Period in a sentence

  • In the event the Declarant is not acting as the ACC, no amendment or supplement made by the ACC to these Regulations & Standards during the Declarant Control Period shall be effective unless the Declarant provides its prior express written consent to such amendment, which consent is within Declarant’s sole and absolute discretion.

  • These Regulations & Standards shall not apply to Declarant’s activities during the Declarant Control Period.

  • All of the rights reserved by Declarant in this Article 4 and in other Articles of this Declaration may not be amended or modified without written consent of the Declarant during the Declarant Control Period.

  • During the Declarant Control Period, the Declarant shall have the right to use any Unit owned by it, and any part of the Common Areas in furtherance of any activities designed to accomplish or facilitate construction, improvement and sale of all Units owned by the Declarant or to be added to the Project, and the construction and improvement of all Common Areas and/or Limited Common Areas as the Declarant may desire.

  • Such rules and regulations shall not be binding on the Declarant during the Declarant Control Period (defined in Article 4 below).


More Definitions of Declarant Control Period

Declarant Control Period means and refer to the period of time beginning upon the date that this Declaration is put of record in the Clerk's Office and ending upon the first to occur of either (i) twenty (20) years after the date at which this Declaration is put of record in the Clerk’s Office, or (ii) when one-hundred percent (100%) of the Lots permitted by the zoning approval for the Development have certificates of occupancy issued for the residences constructed thereon and have been conveyed to parties other than the Declarant or its principals or builders/developers holding title for the purpose of construction andresale, or (iii) when the Declarant voluntarily terminates the Declarant Control Period.
Declarant Control Period means the period of time extending from the recordation of this Declaration to the earliest of (i) that date upon which more than seventy-five percent (75%) of the Condominiums which may be included in the Project have been conveyed to owners other than Declarant; (ii) the date two (2) years after the first Condominium has been conveyed to an owner other than Declarant; or (iii) the date upon which Declarant notifies the owners that Declarant relinquishes its rights under this Declaration and the Bylaws to appoint and remove a majority of the members of the Board of Directors or to exercise powers and responsibilities otherwise assigned by the Condominium Instruments to the Association, the Board of Directors, or any officer of the Association.
Declarant Control Period means the period of time during which the Declarant is entitled to appoint and remove officers and members of the Board as set forth herein.
Declarant Control Period means the period of time from when this Declaration is recorded until the first to occur of: (i) the total number of votes held by Class "A" Members exceed the total number votes held by the Class "B" Member; (ii) 15 years pass from the date this Declaration is recorded; or (iii) the Class "B" Member elects to end the Declarant Control Period.

Declarant Control Period means the period beginning on the date of this Declaration and ending on the earliest of (a) sixty (60) days after conveyance of seventy-five percent (75%) of the Units that may be created on the Property to Unit Owners other than the Declarant or a Dealer, or (b) two (2) years after Declarant and all Dealers have ceased to offer Units for residential purposes for sale in the ordinary course of business, or (c) two (2) years after the Declarant's right to add more Units for residential purposes on the Property was last exercised.
