Deed Restriction definition

Deed Restriction means Land Use Code Section 5-1304.
Deed Restriction or “environmental easement” means a legal restriction on a property that grants a real property interest to the state to enforce maintenance requirements, monitoring requirements, or land use restrictions.
Deed Restriction means an encumbrance on the property that controls the use of the property. The restriction runs with the land in favor of the State and contains the use restriction(s) and/or any prohibition(s) on the use of land in a manner inconsistent with engineering controls.
