Defective Products definition

Defective Products means Products which contain manufactured defects which prevent them from being used for their intended purpose;
Defective Products means any Product which fails to meet the warranty contained in Section 2.8 within the warranty periods described in Schedule A. “Defective Products” shall specifically exclude, without limitation, any Products (i) which have been subjected to misuse, negligence, accident, or improper maintenance, installation, or application or (ii) which have been altered without the Sensor-Technik’s prior written consent.
Defective Products means Products that are not in accordance with technical and other specifications specified or otherwise established by SKF or are not fit for the purpose intended. In the absence of documented SKF requirements, ”Defective Products” shall mean Products that are not in accordance with approved sample deliveries of the Products or where no samples are delivered, do not conform to generally accepted industry standards.

Examples of Defective Products in a sentence

  • As an alternative to (i) through (iii), Buyer may accept the Defective Products conditioned on Seller providing a refund or credit in an amount reasonably determined by Buyer to represent the diminished value of the Defective Products.

  • All costs related to inadequate quality or Defective Products are the responsibility of the Supplier.

  • If the Distributor timely notifies Bollore that it rejects all or part of a shipment, Bollore, at its sole expense, shall have 30 days after receipt of such notice (a) to cure any defect by providing substitute Products or causing the Defective Products to meet its customary quality standards, or (b) to provide a credit to the Distributor for the amount due Bollore for such Defective Products or refund such amount if previously paid.

  • If any Products are materially damaged, defective and not usable or saleable in the ordinary course of the Distributor's business ("Defective Products"), then the Distributor's sole and exclusive remedy (subject to the fourth paragraph of this Section 2) shall be rejection of the Defective Products with a right to a refund of the payment for such Defective Products if they have been paid for (as provided below) and without obligation to pay for such rejected portion if they have not been paid for.

  • Promptly upon learning of any Defective Products, Seller will develop, document and implement corrective actions in accordance with all applicable quality control policies and standards of Buyer and its customers.


More Definitions of Defective Products

Defective Products used herein refers to the Product which has been detected or defected during storage or transportation, after it passed the acceptance testing at the inspection conducted by the Distributor.
Defective Products means products shipped by Vendor to Company pursuant to this Agreement that are Defective.

THE FOREGOING REMEDY CONSTITUTES PURCHASER’S SOLE AND EXCLUSIVE REMEDY AND COMPANY’S ENTIRE LIABILITY FOR DEFECTIVE PRODUCTS.
