Deficiency Notices definition
Deficiency Notices. All notices and other written communications from any Agency or Governmental Authority which licenses, regulates, certifies, accredits or evaluates the Property Related Persons, the Property or the operation of the Property by the Property Related Persons alleging that the Property Related Persons, the Property or the operation of the Property by the Property Related Persons in whole or in part fails to comply or, if corrective action is not taken, shall fail to comply with, any or all of the Agency's or Governmental Authority's requirements for and conditions of licensing, regulation, certification or accreditation by or participation in programs of the Agency or Governmental Authority or otherwise relating to the continuous operation of all or any portion of the Property or the programs of the Property Related Persons or the eligibility or entitlement of the Property Related Persons to receive reimbursement from any Agency or Governmental Authority.
Deficiency Notices all notices and other written communications from any Agency or Governmental Authority which licenses, regulates, certifies, accredits or evaluates the Borrower and its Subsidiaries, the Living Facilities or the operation of the Living Facilities by the Borrower and its Subsidiaries alleging that the Borrower or any of its Subsidiaries, any of the Living Facilities or the operation of the Living Facilities by the Borrower or any of its Subsidiaries in whole or in part fails to comply or, if corrective action is not taken, shall fail to comply with, any or all of the Agency's or Governmental Authority's requirements for and conditions of licensing, regulation, certification or accreditation by or participation in programs of the Agency or Governmental Authority or otherwise relating to the continuous operation of all or any portion of the Living Facilities or the programs of the Borrower and its Subsidiaries or the eligibility or entitlement of the Borrower and its Subsidiaries to receive reimbursement from any Agency or Governmental Authority.
Deficiency Notices means the notices issued to the Settlement Class Members on or about February 27, 2002 by the Miami-Dade County Unsafe Structures Board informing them that certain structural defects appeared in the common elements of their Condominium Units and that these defects had to be remediated or the units would be ordered demolished. A copy of a Deficiency Notice is attached as Exhibit 2.

More Definitions of Deficiency Notices
Deficiency Notices shall refer to all notices from Governmental Authorities which license, regulate, certify, accredit or evaluate Borrower Parties, any Project or the operation of any Project alleging that Borrower, Company, the Project or the operation of the Project fails to comply with any or all conditions of licensing, regulation or accreditation of the Project, and all follow up correspondence relating thereto. Borrower Parties shall promptly and diligently pursue the correction of the subject of the Deficiency Notice prior to the expiration of any period allowed by the Governmental Authority for correction. Borrower Parties shall promptly provide from time to time, such cost estimates, reports and other information as KCCI may require to demonstrate to KCCI's satisfaction that Borrower and/or Company have the financial and other ability to effect the correction and are taking the actions required by this Section. -34- (z)

Deficiency Notices means all notices and other written communications from any Agency or Governmental Authority which licenses, regulates, certifies, accredits or evaluates the Facility Related Persons, the Facilities or the operation of the Facilities by the Facility Related Persons alleging that the Facility Related Persons, the Facility(ies) or the operation of the Facility(ies) by the Facility Related Persons in whole or in part fails to comply or, if corrective action is not taken, shall fail to comply with, any or all of the Agency's or Governmental Authority's requirements for and conditions of licensing, regulation, certification or accreditation by or participation in programs of the Agency or Governmental Authority or otherwise relating to the continuous operation of all or any portion of the Facility(ies) or the programs of the Facility Related Persons or the eligibility or entitlement of the Facility Related Persons to receive reimbursement from any Agency or Governmental Authority.

The Borrower shall promptly and diligently pursue the correction of the subject of the Deficiency Notice prior to the expiration of any period allowed by the Governmental Authority for correction. The Borrower shall, at the Administrative Agent's request, promptly provide from time to time, such cost estimates, reports and other information as the Administrative Agent may require to demonstrate to the Administrative Agent's satisfaction that the Borrower and/or the Manager have the financial and other ability to effect the correction and are taking the actions required by this section.
Deficiency Notices means all notices and other written communications from any Granting Authority alleging that any Charter School or the operation of such Charter School, in whole or in part, fails to comply or, if corrective action is not taken, shall fail to comply with, Applicable Laws or any or all of the Granting Authority’s requirements for, and conditions of, licensing, regulation, certification, authorization or accreditation as a public charter school or by or participation in programs of the Granting Authority or otherwise relating to the continuous operation of all or any portion of such Charter School’s programs or its eligibility or entitlement to receive or continue to receive funding and/or to enroll and educate students at its facilities.
Deficiency Notices means all notices and other written communications from any Agency, Governmental Authority or agent which licenses, regulates, certifies, accredits or evaluates the Project Related Persons, the Project or the Project Related Person's operation of the Project alleging that the Project Related Persons, the Project or the Project Related Person's operation of the Project in whole or in part fails to comply or, if corrective action is not taken, shall fail to comply with, any or all of the Agency's or Governmental Authority's requirements for and conditions of licensing, regulation, certification or accreditation by or participation in programs of the Agency or Governmental Authority or otherwise relating to the continuous operation of all or any portion of the Property or the Project Related Person's programs or its eligibility or entitlement to receive reimbursement from any Agency or Governmental Authority. Dollars shall mean lawful money of the United States. Equity Deficiency as defined in Section 6.3.
Deficiency Notices means, with respect to a Project, all notices and other written communications from any Agency, Governmental Authority or agent which licenses, regulates, certifies, accredits or evaluates the Project Related Persons, the Project or the Project Related Persons' operation of the Project alleging that a Project Related Person, the Project or a Project Related Person's operation of the Project in whole or in part fails to comply or, if corrective action is not taken, shall fail to comply, in a manner which would cause a Material Adverse Change, with, any or all of the Agency's or Governmental Authority's requirements for and conditions of licensing, regulation, certification or accreditation by or participation in programs of the Agency or Governmental Authority or otherwise relating to the continuous operation of all or any portion of the Project or a Project Related Person's programs or its eligibility or entitlement to receive reimbursement from any Agency or Governmental Authority.
