Delay Event definition

Delay Event means any event set out at Clause 5.19.4 [Delay Events].
Delay Event means any of the following events or circumstances only to the extent, in each case, that it affects the critical path of the Construction Schedule:

Examples of Delay Event in a sentence

  • All warranty work shall be carried out and completed at DB Co’s sole cost and expense and warranty work shall not be the basis of a claim for a Delay Event, a Compensation Event, a Variation, additional compensation or damages.

  • If Access Right Holder is affected by a Delay Event, then Access Right Holder must use best endeavours (including by incurring reasonable costs) to mitigate the effect of that Delay Event and Access Right Holder’s performance of its obligations under this agreement affected by the Delay Event as soon as is reasonably practicable.

  • Consequences of a Delay Event DB Co shall provide written notice to the City Representative, the Independent Certifier and the City’s consultant within 5 business days of becoming aware of the occurrence of the delay event.


More Definitions of Delay Event

Delay Event means a delay event (as described in the Capacity Transfer and Auction Timetable in the Capacity Transfer and Auction Procedures) which affects AEMO’s ability to comply with the Capacity Transfer and Auction Timetable;
Delay Event has the meaning set forth in Section 2.6(b).
Delay Event for an off-the-plan contract means any event delaying or preventing completion of the contract. This includes an event delaying or preventing the construction of a building or related works, and a delay in obtaining any approval, registration, permission, exemption, insurance or any other thing necessary for completion of the contract. A delay event does not include an event delaying or preventing completion of the contract that the buyer has caused or substantially contributed to or an event prescribed by regulation.
Delay Event means any act, occurrence or omission causing a delay in the completion of the Services within the time limits set forth in this Agreement.
Delay Event means any event set out at Clause 19.3.

Delay Event means a delay event (as described in the Capacity Transfer and Auction Timetable in the Capacity Transfer and Auction Procedures) that affects AEMO’s ability to comply with the Capacity Transfer and Auction Timetable. Delivery Point means, in respect of a Service, a point on the VicHub at which Gas is delivered or deemed to be delivered under this document from the VicHub to or for the account of a Shipper. Direct Loss means the actual direct and foreseeable Losses incurred by a party which arise naturally according to the usual course of things. Dispute means a dispute, controversy or Claim arising out of or in relation to this document or any of the Services or other obligations to be performed under this document (including, without limitation, any dispute, controversy or Claim regarding the interpretation of any provision of this document). Easement means the easements and other land tenure instruments covering the VicHub right-of-way and vested in the Service Provider or a related body corporate of the Service Provider. EGP means the Eastern Gas Pipeline (and associated laterals) owned and operated by the EGP Service Providers in accordance with the Licences from Longford in the state of Victoria to Xxxxxxx Park, near Sydney in the state of New South Wales.
