A Designated Pool shall remain open for general use during a Scheduled Lesson.
An Authorized Swim Instructor must reserve in advance a Designated Pool for any time that Authorized Swim Instructor proposes to provide a swimming lesson (“Scheduled Lesson”).
Under no circumstances excepting an emergency shall an Authorized Swim Instructor use a cellphone while providing a swim lesson at a Designated Pool.

Designated Pool. As defined in the Recitals.

Designated Pool means, subject to Section 2.10, the pool of Aircraft consisting of the PS Pool Aircraft each of which (i) shall be noted by the Borrower on Schedule 3.17(a) attached hereto, as amended, restated or supplemented from time to time pursuant to this Agreement and (ii) either (x) shall be Owned by a Lessor Subsidiary or (y) each of the Borrower Parties shall have good faith intention and, to FLL’s and the relevant Servicer’s knowledge, the ability to satisfy each of the conditions under the Loan Documents (including the conditions set forth in Section 4.02 of this Agreement) such that such Aircraft will constitute a Pool Aircraft within a reasonable period of time after the Effective Date.

Designated Pool. As of any date, any Pool that is identified and included on the Designated Servicing Agreement Schedule in accordance with Section 2.1(c) on such date. For the avoidance of doubt, with respect to Xxxxxx Xxx Advances, each Designated Pool with respect to such Xxxxxx Mae Advances is identified on Schedule 1 hereto by its Seller/Servicer identification number, listed in the column titled “Seller/Servicer #” in the applicable table on Schedule 1. Designated Pool means, as of any date, any Eligible Pool made subject to a Transaction in accordance with the terms of this Agreement and that is subject to a Servicing Contract, the applicable Agency Agreement, and the applicable Participation Agreement and is identified and included on the Designated Pool Schedule on such date.
