Discretionary Capital Expenditures definition

Discretionary Capital Expenditures means Capital Expenditures made to acquire fee or perpetual easement interests with respect to any Ground Lease Site, one-time payments made to obtain long-term extensions of Ground Leases, or non-recurring expenditures made to enhance the Operating Revenues or decrease the Operating Expenses of a Site.

Discretionary Capital Expenditures means any Capital Expenditures (other than Required Capital Expenditures, Emergency Capital Expenditures and Capital Expenditures financed with the proceeds of Equity Contributions made to the Company) incurred or expended in connection with any modification, alteration, addition or improvement to any Project that a Company Entity considers necessary or desirable in the proper conduct of its business and is not expressly prohibited under the Financing Documents.

Discretionary Capital Expenditures means any Capital Expenditures (other than Capital Expenditures required to be incurred pursuant to the Project Agreement) that have been certified as being reasonable by the Lenders’ Technical Advisor.

More Definitions of Discretionary Capital Expenditures

Discretionary Capital Expenditures means Capital Expenditures relating to the construction of new property, additions to existing property and/or the acquisition of assets; provided, however, that Discretionary Capital Expenditures shall not include the purchase price of any acquisition permitted under Section 6.9.6
