Effect of Application. This Application and Agreement shall become a binding contract between the parties hereto upon execution by the District Manager or an authorized officer. A chronological checklist of matters to be performed by Applicant and District is attached hereto as Exhibit A. Applicant will be charged for all reasonable costs incurred by the District in connection with the project, including but not limited to costs for plan review, project administration, inspections, and legal review. An initial deposit of $500 shall be paid upon execution hereof to be applied to the District’s costs incurred. An estimate of the costs for plan review, project administration and legal review will be submitted to the Applicant upon the District’s approval of this application. An estimate of the costs for construction administration will be submitted to the Applicant upon approval of the plans. Applicant understands that actual costs may be higher than the estimates provided. The District shall notify the Applicant, in writing, at any time it appears that actual costs may exceed the District’s estimates.
Effect of Application. To the extent that any provision of any Application related to any Letter of Credit, or either of the documents referenced in clauses (i) or (ii) of Section 3.12 hereof, is inconsistent with the provisions of this Article III, or with Article XI hereof, the provisions of this Article III or Article XI hereof, as applicable, shall apply. Article XI alone shall govern with respect to Default and Events of Default in connection with any Letter of Credit.
