Eligible Class Member definition

Eligible Class Member means a Settlement Class Member who timely submits a Claim Form or Electronic Claim Form.
Eligible Class Member is a Settlement Class Member who has submitted a Valid Claim Form and whose eligibility has not been challenged by the Defendant within ninety (90) days of the Claim Form Submission Date.
Eligible Class Member means each General Class Member, Overtime Sub-Class Member, and Meal and Rest Period Settlement Sub-Class member who timely and properly completes in full, signs under penalty of perjury, and submits the Forms, in accordance with the requirements of the Preliminary Approval Order.

More Definitions of Eligible Class Member

Eligible Class Member means any Current Owner or Prior Owner who is entitled to receive a payment from the Net Settlement Amount under the Plan of Allocation. As described further below, the Plan of Allocation assumes that any payment will be made only to the Current Owner of a Class Member’s royalties and overriding royalties for CBM from the Fruitland formation in the San Juan Basin during the Class Period who did not opt out of the Class absent a determination that a Prior Owner is entitled to a portion of such payment.
Eligible Class Member means a Class Member who has submitted a timely and proper Claim Form in accordance with the requirements set forth in this Agreement.
Eligible Class Member means all Settlement Class Members who do not timely opt out of the Settlement Class.
Eligible Class Member means a Class Member who is a natural person and who included a Pre-Insolvency Debt owing to 407 ETR on a Statement of Affairs in the BIA process;
Eligible Class Member means any Class Member who submits a Claim form in compliance with this Stipulation.
