Energy Costs means a charge for the cost items included in the locational marginal price for the applicable ISO zone for each account.

The first year amount of Savings for Energy Costs is the sum of the below listed ECMs. Actual Savings may be lower than as set forth in the Schedule of Guaranteed Savings because of an absolute increase in Energy use due to the implementation of measures to increase environmental comfort as directed by the Customer, and other baseline adjustments (see Section D.2).
The Guaranteed Savings for a Guarantee Year in which such termination becomes effective shall be prorated as of the effective date of such termination, with a reasonable adjustment for seasonal fluctuations in Energy Costs and Operational Costs, and the Guaranteed Savings for all subsequent Guarantee Years shall be null and void.

Energy Costs means a charge for the cost items included in the Locational Marginal Price for the ISO residual zone identified in the Account Schedule “FERC Order 745 Costs” means any costs or charges imposed by the ISO in accordance with complying with the provisions of Federal Energy Regulatory Commission (“FERC”) in Order No. 745 18 CFR Part 35 (March 15, 2011). Any modifications or conditions to the treatment of FERC Order 745 Costs under the ISO tariff or otherwise shall be deemed a change in law pursuant to Section 5 of the General Terms and Conditions of this Agreement.
Energy Costs means amounts paid for or in respect of electricity, whether under a bilateral contract or a contact for differences or by way of payments under the BSC or the TSC for differences between nominated volumes of electricity and metered volumes;
